1. Acceptance of Terms

It is a condition of use of this Site that you accept and agree to the following terms and conditions of USM Ltd ("the Company") incorporating USM Digital. No other terms shall apply unless stated below.

Only UK residents may register as users of the Site or apply for any of the services on offer. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with any applicable local laws.

2. Age Restrictions

All persons under the age of 18 are denied access to usmdigital.co.uk. If you are under 18 years of age, it is unlawful for you to visit, read, or interact with usmdigital.co.uk or its contents in any manner.

3. Data Services

3.1 Mailing Lists and Telemarketing Leads

The supplied mailing list/telemarketing leads are rented out on a "single use" only basis. This does not include the right of sale and, if used more than once, is subject to a fee equal to the base rental x 10.

3.2 Data Profiling, Matching and Appending

Data Profiling, Matching and Appending is available for clients using the 'self-service' data matching tool. USM Digital charges for this service on a 'per thousand' cost of the data or on a Project Management Fee basis.

4. Marketing Campaigns

Campaigns will be made utilising the client's brand and proposition subject to approval by the USM Digital compliance team. USM Digital has the right to decline creatives submitted for reasons of compliance.

5. Web Presence Services

For website design, build and hosting services:

• Standard quotations will be given following initial briefing on template solutions
• USM Digital reserves the right to confirm quotation following agreed technical specification with the client
• Deposits will be taken on order signing
• Balances (where applicable) will be paid within 30 days following website 'sign off'

6. Intellectual Property

No material from this Site may be copied, uploaded, posted, modified or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, home use only, provided you keep intact all copyright and other proprietary notices.

The use of any such material on any other website or computer environment is prohibited.

7. Submissions

Visitor agrees as a condition of viewing, that any communication between Visitor and Website is deemed a submission. All submissions, including portions thereof, graphics contained thereon, or any of the content of the submission, shall become the exclusive property of the Website and may be used, without further permission, for commercial use without additional consideration of any kind.

8. Disclaimer of Warranties

The Company provides the Site for your general interest and information only. The Company makes no representation or warranties about the accuracy or suitability of any product or purpose of any content of the Site and all other implied warranties are excluded to the fullest extent permissible under English law.

Any third party software which may be downloaded from a site operated by a third party is the responsibility of that party and not of the Company, who shall have no responsibility or liability arising in respect of any loss, damage, viruses or otherwise arising as a result of the downloading by you of such software.

9. Dispute Resolution

If any matter concerning this purchase shall be brought before a court of law, Visitor agrees that the sole and proper jurisdiction to be the state and city declared in the contact information of the web owner. Visitor agrees that the applicable law to be applied shall, in all cases, be that of England and Wales.

10. Changes to Terms

The Terms of Use agreement may change from time to time. Visitors have an affirmative duty, as part of the consideration for permission to view usmdigital.co.uk, to keep themselves informed of changes.

11. Refund Policy
